A Superior man has been sentenced to five years in prison for his role in the November armed robbery of Kosta's Gyros.

Daniel John Homsey, 28, pleaded guilty April 17 to a charge of party to armed robbery in Douglas County Circuit Court. Last week, he was sentenced to five years in prison and five years extended supervision. Homsey was ordered to have no contact with victim, business or co-defendant and pay $518 court costs. One count of party to false imprisonment with use of dangerous weapon was dismissed but read in for sentencing.

According to the complaint:

Homsey and Curtis Buddy Robertson, 29, of Duluth took part in the armed robbery shortly after midnight Nov. 19. The two men walked into the restaurant wearing heavy, dark-colored winter coats with hoods up and bandanas over their faces. One pointed a semi-automatic pistol at the employee working as the other tried to open the cash register by pushing buttons.

The employee opened the register for them, and the two men took the cash from the drawer as well as the employee's cell phone.

Superior police collected digital pictures of the vehicle used in the robbery from a nearby surveillance camera and released them to the public. A tip-line informant pointed police in the direction of Homsey. When Detective William Braman spoke to Homsey, he admitted taking part in the robbery to get money for drugs.

Robertson faces felony charges of party to armed robbery and party to false imprisonment with use of a dangerous weapon. His next court appearance is set for July 10.
