A Superior man will spend almost a year in jail for driving drunk for a fifth time.
Joseph Alan Johnson, 53, pleaded no contest in Douglas County Circuit Court on Sept. 9 to fifth offense operating while intoxicated. He was sentenced to two years of probation and 360 days in jail. Huber release was granted for work and treatment. Johnson’s driver’s license was revoked for 36 months. He was also ordered to pay a $3,841 fine, take a chemical dependency evaluation, install an ignition interlock, submit to random urinalysis and not possess or consume alcohol. A charge of fifth offense operating with a prohibited alcohol concentrationwas dismissed.
A two-year prison sentence followed by two years of extended supervision was imposed and stayed by Judge Kelly Thimm. If Johnson does not follow the terms of his probation, he would face the prison sentence.

According to the criminal complaint:
Superior police responded to a call of a reckless driver on Belknap Street the evening of May 3. Johnson was identified as the driver of the truck. He did not pull the vehicle over immediately when the officer behind him activated his emergency lights and had difficulty completing a simple parking maneuver. When questioned, Johnson said he had consumed about four or five beers. His blood alcohol level was 0.22, nearly three times the legal limit.
