Public comment on Wisconsin mining law sought

The Department of Natural Resources is seeking public comment on rule revisions required by the new ferrous mining law, Wisconsin Act 1.

The agency will also hold two public hearings on the rule changes - the first hearing will be held in Ashland on Monday from 4-7 p.m., in Room 305 of the Wisconsin Indianhead Technical Institute, 2100 Beaser Ave. The second hearing will be in Madison on Nov. 15 from 1-4 p.m., in Room G09 of the state Natural Resources Building (GEF 2), 101 S. Webster St.

The rule revisions are required by Section 103 of 2013 Wisconsin Act 1, the Ferrous Mining Law. The department is proposing the changes to bring certain existing rules into conformity with the statutory changes made by the new law. No changes other than those mandated under Section 103 are proposed.

The proposed rules apply statewide and are not specific to any one project. The rules clarify that ferrous mining activities are regulated by subchapter III of chapter 295, Wis. Stat., and nonferrous mining activities are regulated under chapter 293, Wis. Stat., and the nonferrous mining regulations.

Submitting comments

Public comments on the proposed rule must be received on or before Dec. 2. Written comments may be submitted by U.S. mail, fax, e-mail or through the Internet and will have the same weight and effect as oral statements presented at the public hearing.
