A felony battery charge against a Superior man who allegedly crushed the cheek bones of an opponent in a fight outside a Billings Park bar was dismissed Monday in Douglas County Circuit Court.
Jason Michael Sutherland, 30, is accused of getting in a "tussle" with another Superior man after they argued inside the bar on Dec. 16, according to the criminal complaint. The fight continued outside the bar near the back door and Sutherland allegedly kicked the other man in the face.
Assistant District Attorney Rebecca Lovejoy requested the substantial battery charge be dismissed and Judge George Glonek granted the motion.
An additional misdemeanor count of second offense operating a motor vehicle while revoked was amended to an ordinance violation of driving a motor vehicle with no valid driver's license. Sutherland pleaded no contest to the amended charge and was ordered to pay a $200 fine.
