RESOLUTION # R20-13522
FINAL RESOLUTION INTRODUCED BY THE PUBLIC WORKS DEPARTMENT AUTHORIZING ALLEYS TO BE BLACKTOPPED IN A CERTAIN LOCATION WITHIN THE CITY OF SUPERIOR IN 2021.
WHEREAS, The Common Council of the City of Superior, Wisconsin did on September 1, 2020, adopt a preliminary resolution declaring intent to exercise special assessments upon property within the following area for benefits conferred upon such property by the installation of blacktop alleys. The Common Council hereby declares its intention to exercise its power under Wisconsin Statutes 66.0703(7), to levy special assessments upon property within the following described areas for benefits conferred upon such property by the installation of a blacktop alley between:
1.19th & 20th Streets North, between John Avenue & Hughitt Avenue
2.6th & 7th Streets East, between 18th & 19th Avenues East
3.16th & 17th Streets North, between Hughitt Avenue & Hammond Avenue
4.22nd Street North to Faxon Street & Catlin Avenue to Cypress Avenue
5.4th & 5th Streets East, between 13th & 14th Avenues East
6.22nd Avenue Ease heading southeast to Dead end, between 13th & 14th Streets East
WHEREAS, all owners of said property have been notified of this hearing, required by Section 66.0703(7) Wisconsin Statutes, by the City Clerk.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Superior as follows:
1.That the report of the Department of Public Works pertaining to the construction of the above-described public improvements which has been filed in the office of the City Clerk, including plans and specifications therefore, is hereby adopted and approved.
2.That the Department of Public Works is directed to carry out the work of such improvements in accordance with the report.
3.That payment for said improvements be made by assessing the cost to the property benefited as indicated in said report.
4.That benefits and damages shown on the report are true and correct and are hereby confirmed.
5.That the assessments for all projects included in said report are hereby combined as a single assessment, but any interested property owner shall be entitled within the time limits and under the procedures of Wis. Stats. 66.0703(7) to appeal each assessment separately or both assessments jointly for any purpose or purposes.
6.That assessments may be paid in cash or in ten (10) annual installments to the City Clerk. Installments or assessments not paid when due shall bear additional interest on the amount due at the rate of .8 of 1% per month and shall be extended upon the tax roll as a delinquent tax against the property. All proceedings in relation to the collection, return and sale of property for delinquent real estate taxes shall apply to said special assessment, except as otherwise provided by statute.
