The Regular Meeting of the Common Council was called to order by Mayor Jim Paine at 6:30 p.m. in the Government Center, Board Room 201.

3. APPROVAL OF MINUTES April 20, 2021 - Regular Council Meeting.
MOTION by Councilor Bender, seconded by Elm and carried, to approve.

6. MAYOR'S REPORT
6.1 The Mayor's Report.
6.2 Recommending approval to appoint Cindy Ellefson and Danna Livingston-Matherly to the Commercial Sexual Exploitation Commission for a three-year term ending May 2024; and re-appoint Jane Anklam to the Urban Forestry Tree Board for a three-year term ending May 2024.
MOTION by Councilor Bender, seconded by Ludwig and carried, to approve.

1) To approve the WPAA-Police Union Lateral Transfer Side Letter Agreement.
MOTION by Councilor Bender, seconded by Ledin and carried, to approve.
7.2 Public Works Committee, April 21, 2021
Report from the Chair.
1) To approve the purchase of one (1) John Deere 35G Compact Excavator.
2) To approve RESOLUTION #R21-13554 supporting the Richard I. Bong Memorial Airport Parallel Taxiway.
MOTION by Councilor Bender, seconded by Ludwig and carried, to adopt the resolution.
3) To approve the Pavement Marking Contract with Fahrner Asphalt.
4) To approve the Tower Avenue Concrete Replacement contract with Chippewa Concrete Services.
5) To approve the Tower Avenue Capacity Analysis Agreement with the Northwest Regional Planning Commission.
MOTION by Councilor Sutherland, seconded by Ludwig and carried, to approve the remainder of 7.2.

Mayor Paine requests that the Council take items out of order, and hear item 7 immediately. There was no objection to this request.
1) To approve the small business grant application from DC Testing.
2) To approve the small business grant application from Sutherland CBD.
MOTION by Councilor Fennessey, seconded by Ludwig and carried, to approve. Councilor Sutherland abstained.
3) To approve the small grant application from Ligman Properties LLC.
4) To approve the small business grant application for Superior Waffles.
5) To approve the bluff buffer appeal.
6) To approve the Resolution of the Plan Commission of the City of Superior, Wisconsin, calling for public hearing on the proposed creation of a Tax Incremental District, Proposed Boundaries and Proposed Project Plan for the Winter Street Business Park Project.
MOTION by Councilor Elm, seconded by Fennessey and carried, to approve the remainder of the Plan Commission business.
7) To approve RESOLUTION #R21-13552 introduced by the City Plan Commission authorizing a Special Use Permit for a Transitional Home at 2626 Ogden Avenue.
Debbie Latscher, Martin Goldberg, Lonnee Aakeberg, Caty Whitby, Chad Wilson, speak in opposition to the resolution. Joe Brennan spoke in favor of resolution.
MOTION by Councilor Fennessey, seconded by Ludwig to adopt the resolution. Roll call vote taken and passed.
AYE - 8 Ledin, Van Sickle, Fennessey, Elm, Ludwig, Sutherland, Kern, Graskey.
NO - 2 Bender, Sweeney.
8.5 Public Safety, April 21, 2021
Report from the Chair.
1) To approve ORDINANCE #O21-4237 introduced by Police Chief Nick Alexander of the City of Superior amending Section 86-13, Chronic Nuisance Premises, of the Code of Ordinances.
MOTION by Councilor Sutherland, seconded by Elm and carried, to adopt the ordinance.
2) To approve the purchase of a virtual reality trainer (Recommended at the February 17th meeting.)
MOTION by Councilor Sutherland, seconded by Bender and carried, to approve.
8.6 Urban Forestry Tree Board, April 15, 2021
Report from the Chair.
1) To create and send out a Request for Proposals on the scope and next steps for the Superior Municipal Forest Master Planning.
MOTION by Councilor Sutherland, seconded by Bender and carried, to approve.

10. NEW BUSINESS
10.1 Public Works Director Janigo recommending approval of a seven-year agreement with the Commemorative Air Fore Lake Superior Squadron 101 to occupy a portion of the sign on Tower Avenue currently displaying Upper Deck Restaurant information.
MOTION by Councilor Elm, seconded by Fennessey and carried, to approve.
10.2 RESOLUTION #R21-13553 of the Common Council of the City of Superior, Wisconsin, Supporting the Protect the Right to Organize Act.
MOTION by Councilor Ledin, seconded by Bender and carried, to adopt the resolution.
10.3 ORDINANCE #O21-4236 introduced by the Common Council of the City of Superior amending City Code Chapter 112 - Traffic Code, Schedule J, Disabled Parking Zones, by adding 1811 N 17th Street, Apt 1 (both sides).
MOTION by Councilor Elm, seconded by Sutherland and carried, to adopt the ordinance.

10.4 Council President Elm and Vice President Van Sickle recommending approval of Council Committee appointments.
MOTION by Councilor Elm, seconded by Sutherland and carried, to approve.
