The Regular Meeting of the Common Council was called to order by Mayor Jim Paine at 6:30 p.m. in the Government Center, Board Room 201.

5.PUBLIC HEARINGS
5.1 R20-13505Resolution introduced by the Environmental Services Division of Public Works and the Superior Technical Advisory Committee to accept and approve the update to the City of Superior Sewer Service Area Plan as 2040 City of Superior Urbanized Area Sewer Service Plan; Authorizing staff to submit the update to the to the Wisconsin Department of Natural Resources.
No one spoke in favor of or opposition to.

8.1 Recommending approval of miscellaneous licenses.
MOTION by Councilor Dalbec, seconded by Bender and carried, to approve.

8.2 Recommending approval to amend the premise of a Class B Liquor & Beer License by Dodgies East End Tavern, 2114 E 5th Street, for a special event on June 27, 2020.
MOTION by Councilor Bender, seconded by Sutherland and carried, to approve.
8.3 Recommending approval of an Original Class B Liquor & Beer license for Whisky's Last Resort, LLC, Trade Name: Whiskey's Last Resort, 318 Tower Avenue, Agent: Jeremy Harris, for the license period of July 1, 2020 - June 30, 2021.
MOTION by Councilor Bender, seconded by Dalbec and carried, to approve.

8.4Recommending approval to allow pertinent city officials to enter into a grant agreement with the Wisconsin Department of Transportation and provide a $10,000 match per the grant requirements for the purpose of funding Superior's portion of the EDTA's COA.
MOTION by Councilor Bender, seconded by Ludwig and carried, to approve.
8.5Recommending approval to put up for bid a parcel of land located near Albany Avenue and North 58th street with a minimum bid of $4,125.
MOTION by Councilor Ledin, seconded by Bender and carried, to approve.

8.6 Recommending approval to award contract the Engineering Services for K Street Storm Sewer Repair Phase II to Donohue & Associates, Inc. at a proposed amount of $53,745, with authorization to have the option to award construction related services at an amount estimated at $38,730.

8.7 Recommending approval the recommendations made by the Parks Commission for the allocation of the 2020 Recreational Grant Award.

9.BUSINESS BY THE MAYOR
9.1Recommending approval to re-appoint Justin Holmes to the Urban Forestry Tree Board for a term expiring June, 2023; and re-appoint Arthur Gil de Lamadrid to the Police and Fire Commission for a term expiring June, 2025.
MOTION by Councilor Bender seconded by Ludwig and carried, to approve.

11.1 R20-13504 Resolution introduced by the Common Council concerning the Wisconsin Department of Natural Resources Compliance Maintenance Annual Report (CMAR) for 2019.
MOTION by Councilor Elm, seconded by Bender and carried, to adopt the resolution.
11.2 R20-13506 Resolution introduced by the Common Council of the City of Superior, Wisconsin, approving a three-year Harbor Development Statement of Intentions for the years 2021-2023.
MOTION by Councilor Dalbec, seconded by Elm, and carried, to adopt the resolution.
12. ORDINANCES
12.1 O20-4196 Ordinance introduced by the Common Council of the City of Superior amending City Code Chapter 112 - Traffic Code, Schedule J, Disabled Parking Zones by removing 1318 Baxter Avenue (both sides).
MOTION by Councilor Elm, seconded by Ludwig and carried, to adopt the ordinance.
12.2 O20-4197 Ordinance introduced by the Common Council of the City of Superior amending City Code Chapter 112 - Traffic Code, Schedule J, Disabled Parking Zones by removing 2619 Ogden Avenue (one side).
MOTION by Councilor Bender seconded by Ludwig and carried, to adopt the ordinance.
12.3 O20-4198Ordinance amending the City Code, of Ordinances, Chapter 14, Section 14-52 relating to the issuance of Tavern Operator Licenses.
MOTION by Councilor Dalbec, seconded by Bender and carried, to adopt the ordinance.

AN ORDINANCE INTRODUCED BY THE COMMON COUNCIL OF THE CITY OF SUPERIOR AMENDING CITY CODE CHAPTER 112 - TRAFFIC CODE, SCHEDULE J, DISABLED PARKING ZONES

The Common Council of the City of Superior, Wisconsin, does ordain as follows:
SECTION 1.Schedule J, Disabled Parking Zones (Sec. 3-12(a)(1)) of the Traffic Code, is hereby amended by removing the following:
Disabled: Parking signs (one side) at: 2619 Ogden Avenue
SECTION 2.Signs. The Department of Public Works is hereby authorized and directed to remove official traffic signs.
SECTION 3.All ordinances and parts of ordinances in conflict herewith are hereby repealed.
SECTION 4. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional by reason of any decision of any court of competent jurisdiction, such decision shall not affect the validity of any other section, subsection, sentence, clause or phrase or portion thereof.
SECTION 5. This ordinance shall take effect and be in force from and after its passage and publication, as provided by law.

AN ORDINANCE AMENDING THE CITY CODE OF ORDINANCES CHAPTER 14, SECTION 14-52 RELATING TO THE ISSUANCE OF TAVERN OPERATOR LICENSES

The Common Council of the City of Superior, Wisconsin, does ordain as follows:
SECTION 1.Chapter 15, Article III Issuance and Renewal, Sec 14-52 Common Council action required to issue or renew license. of the City Code of Ordinances is hereby amended to read:
Section 14-52 Common Council action required to issue or renew license.
(a)Except as provide in subsection (b) and (f) of the section, ….
(f)Issuance of Operator Licenses. Pursuant to Wis. Stats., the City Clerk of the City of Superior shall be designated as the municipal official authorized to issue Tavern Operator's licenses with the same authority allowed in 125.17.
SECTION 3.All ordinances and parts of ordinances in conflict herewith are hereby repealed.
SECTION 4.If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, unconstitutional by reason of any decision of any court of competent jurisdiction, such decision shall not affect the validity of any other section, subsection, sentence or clause or phrase or portion thereof.
SECTION 5. This ordinance shall take effect and be in force from and after its passage and publication, as provided by law.
