AN ORDINANCE INTRODUCED BY MAYOR PAINE AMENDING THE CITY CODE, CHAPTER 2, ADMINISTRATION, ARTICLE II, COMMON COUNCIL, SECTION 2-32 CALL TO ORDER
The Common Council of the City of Superior, Wisconsin does ordain as follows:SECTION 1. City Code Chapter 2, Administration, Article II, Section 2-32 is hereby amended by amended to read as follows:
Sec. 2-32. - Call to order.
(a) Council member absence-Participation by audio and/or video conferencing. Any member who, for good cause, is unable to be physically present at a meeting of the council, may notify the City Clerk's Office within 24 hours of the meeting and request to participate in a meeting by audio and/or video conferencing. accommodations will be made so that the physically absent member can hear and can be heard by all those who are present. The member shall be entitled to participate and vote to the fullest extent possible; however, the member shall not be entitled to participate and vote on any matter that requires the member's physical presence to make observations of any witness, physical evidence or exhibits that have not been previously reviewed by the member. A member who is not physically present shall not count towards a quorum.
(b) The same accommodations will be made for council standing committees and special committees with the absent member notifying the recording staff for the committee. Whenever a regular member of a committee participates via audio and/or video conferencing and the committee alternate is physically present, the alternate member will be considered the voting member.
(c) Call to order. The presiding officer shall at the appointed hour call the members to order. In the absence of the presiding officer, the city clerk, or in the clerk's absence, any member may call the council to order, and there upon the council shall elect a temporary chair to preside at such meeting.
SECTION 3. All ordinance and parts of ordinances in conflict herewith are hereby repealed.
SECTION 4. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional by reason of any decision of any court of competent jurisdiction, such decision shall not affect the validity of any other section, subsection, sentence, clause or phrase or portion thereof.
SECTION 5. This ordinance shall take effect and be in force from and after its passage and publication, as provided by law.
