ORDINANCE No. O22-4279 AN ORDINANCE INTRODUCED BY THE LICENSES AND FEES COMMITTEE AMENDING CHAPTER 14, ALCOHOL BEVERAGES, OF THE CITY OF SUPERIOR CODE OF ORDINANCES, TO UPDATE CODE REGULATING 1-DAY CABARET LICENSES IN ARTICLE III – ISSUANCE AND RENEWAL The Common Council of the City of Superior, Wisconsin does ordain as follows: SECTION 1. Chapter 14 – Alcohol Beverages, Article III, ISSUANCE AND RENEWAL, Sections 14-58(c)(4); 14-165; and 14-170-189 of the City Code of Ordinances are hereby amended to read as follows: Sec. 14-58. – Premises, (c) Outdoor alcohol consumption license: (4) Amplified sound. Amplified sound, such as music, is permitted but may not be audible outside of the outdoor seating area unless a one day outdoor cabaret license has been obtained. Outdoor music is limited to the following hours: Sunday-Thursday from 12:00 p.m.—10:00 p.m., and Friday-Saturday from 12:00 p.m.—12:00 a.m. — Sec. 14-165. - Required. No dancing, whether private or public, or exhibitions or entertainment of whatever nature, commonly classed under the term “cabaret,” “nightclub” or “floor show” performance shall be permitted on any premises licensed under this chapter unless a cabaret license has been also issued for such premises. — Sec. 14-170. - One-Day Cabaret Licenses. A one-day cabaret license application should be submitted at least 15 days prior to event date, to allow for council approval. If an applicant can provide proof of unavoidable time constraints, a one-day cabaret license may be issued at the discretion of the City Clerk’s Office (in collaboration with the Police and Fire Departments). The application fee for a one-day cabaret license or a one-day outdoor cabaret license is $50. Outdoor music is limited to the following hours: Sunday-Thursday from 12:00 p.m.—10:00 p.m., and Friday-Saturday from 12:00 p.m.—12:00 a.m. Sec. 14-171—l4-189. - Required. SECTION 2. All ordinances and parts of ordinances in conflict herewith are hereby repealed. SECTION 3. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, unconstitutional by reason of any decision of any court of competent jurisdiction, such decision shall not affect the validity of any other section, subsection, sentence or clause or phrase or portion thereof. SECTION 4. This ordinance shall take effect and be in force from and after its passage and publication, as provided by law. Passed and adopted this 2nd day of August, 2022.
