WHEREAS, the Building Inspector of the City of Superior, acting under and by virtue of the authority vested by Wisconsin Statues and Ordinances of the City of Superior, including but not limited to Wisconsin Statues, section 66.0413 and the City of Superior Property Maintenance Code, has inspected the property on February 5, 2020 in which you are the fee owner or the holder of a legal or equitable interest, which is located at:

WHEREAS, upon inspection by the City of Superior Fire Department, the Chief Building Inspector has determined that damage resulting from a fire which occurred on February 4, 2020 has rendered the house on this property unreasonable to repair to comply with all statutory and code requirements and;

WHEREAS, the inspection revealed that the building is in violation of the following City of Superior Code of Ordinances:

Sec. 58-20. - Public nuisance declared.
Sec. 104-245. - Vacant structures and land.

WHEREAS, it is unreasonable to repair these structures due severity of damage resulting from the February 4, 2020 fire; because the cost of the repairs will exceed fifty (50) percent of the assessed value of the building divided by the ratio of the assessed value to the recommended value as last published by the department of revenue for the City of Superior.

THEREFORE, YOU ARE HEREBY ORDERED TO DO THE
FOLLOWING:

On or before the 30th day after service of this order, you shall raze and remove the building, burnt materials, garage, and all debris and restore the site to a dust-free and erosion-free condition.

1. If you fail or refuse to comply with this order within the time set forth in the above paragraph, the Building Inspector and others designated by the Building Inspector shall raze and remove the buildings and restore the site to a dust-free and erosion-free condition and the cost of such razing, removal and restoration shall be charged to the owner and become a lien against the real estate described above which shall be assessed and collected as a special tax.

2. If the property contains any personal property or fixtures which will unreasonably interfere with the razing of the building, on or before the 30th day after service of this order, you shall remove the personal property or fixtures. If you fail to do so, the Building Inspector or designees shall store, sell or destroy the personal property and fixtures, at their sole option, and the cost of storage, if applicable, shall be assessed and collected as a special tax against the real estate and a personal obligation of the owner.

3. Anyone affected by this Order shall within thirty (30) days after service of the Order apply to the Circuit Court of Douglas County for an order restraining the Building Inspector from razing and removing such buildings or parts thereof or shall be forever barred. Please see the attached relevant state statutes and administrative rules regarding an appeal of this order.
