NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS June 17, 2022 City of Superior 1316 N. 14th Street Superior, WI 54880 Phone: 715-395-7335 On or about June 27, 2022 the City of Superior will authorize the Superior Housing Authority to submit a request to the Milwaukee HUD field office for the release of Capital Fund Program funds under Section 9 and section 30 of the US Housing Act of 1937 (42 U.S.C.1437 g (d) and 1437z-2)], to undertake a project known as Superior Housing Authority 2022 Capital Fund projects located throughout the City of Superior, WI 54880 for the purpose of Scattered Site – siding and exterior door replacement, including fascia and soffits. Scattered Site interior remodel – kitchen and bath cabinets/countertops, appliances, outdated plumbing, faucets and sinks, tubs/shower/commodes, flooring, lighting, interior doors and hardware; Scattered Site and Turnkey appliances – replace ranges and refrigerators with energy-efficient appliances. The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at The City of Superior City Hall, 1316 N. 14th Street, Superior, WI 54880, and may be examined or copied weekdays 8:00 A.M to 4:00 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the City of Superior. All comments received by June 27, 2022 will be considered by the City of Superior prior to authorizing submission of a request for release of funds. ENVIRONMENTAL CERTIFICATION The City of Superior certifies to the Milwaukee HUD Field office that Jason Serck in his capacity as Planning Director consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. Milwaukee HUD Field office’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Superior Housing Authority to use Program funds. OBJECTIONS TO RELEASE OF FUNDS Milwaukee HUD Field office will accept objections to its release of fund and the City of Superior’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Superior; (b) the City of Superior has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by Milwaukee HUD Field office; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
