The Wisconsin Department of Health Services is investigating a local company after it failed to file a Resident Relocation Plan 90 days in advance of its anticipated closure.

Encompass Healthcare and Assisted Living of Superior notified residents of one of its community-based residential facilities July 1 that they have 30 days, until July 31, to find alternative placements for residents of the community-based residential facility.

Encompass also filed a Resident Relocation Plan with the state July 1.

The time frame did not meet the 90-day advance notice for relocating residents, according to DHS spokeswoman Elizabeth Goodsitt.

According to the letter notifying residents, and forwarded to the Superior Telegram anonymously, president Tyler Nyhus stated a 30-day notice to vacate was given to Encompass by the property owner. Nyhus declined to comment other than to say he lost his lease.

According to DHS records, the facility provides community-based residential services for up to 14 residents of advanced age and receives some public funding to provide services. It’s one of four facilities operated by Encompass in Superior.
