EAU CLAIRE, Wis. (AP) — Authorities are investigating a Fall Creek man who was arrested for allegedly mistreating animals and operating as a dog breeder without a license.
Most of the 27 dogs seized from the man's property in May will be held at the area humane association until a judge rules they can be released. But Eau Claire County Judge Michael Schumacher ruled Friday that one dog and its litter will be returned to its owner — Philadelphia Eagles running back Bryce Brown, the Eau Claire Leader-Telegram reported.
In a court affidavit, Brown said his dog, Eillis, is a pet, and was sent to the man's Fall Creek property for stud services.
The Associated Press is not naming the man because he hasn't been charged. Prosecutors have until July 8 to decide whether to file charges, and Schumacher said he will make a decision on what to do with the animals by mid-July. For now, the rest of the dogs are at the Eau Claire County Humane Association.
The man said in court documents that he thinks the animals were removed because a humane association official believed the pit bulls and bull terriers were fighting dogs.
Bekah Weitz, the humane officer for the Eau Claire County Humane Association, said she saw scarring on seven animals, and some had ringworm and other possible skin issues. Weitz said the animals were also living in moist conditions in houses without floors.
Attorney Ron Poquette, who represented the humane association at a hearing Friday, argued against releasing any dogs.
"At this point, they are still part of the evidence," he said.
Sheila Kessler, Brown's attorney, argued her client is a victim and the value of the puppies decrease the longer they are held.
"It's a lot easier to sell 8-week-old puppies than it is to sell eight-month-old puppies," said Kessler.
