Superior man faces fifth drunk driving charge

A Superior man is facing charges for allegedly operating drunk a fifth time.

Luke John Fredrick, 32, made an initial appearance in Douglas County Circuit Court on Dec. 4. He faces one count each felony fifth offense operating while intoxicated and misdemeanor operating a motor vehicle while revoked.

He was released on a $500 cash bond, and ordered not to use or possess any alcohol and operate a motor vehicle without a valid driver’s license.

According to the criminal complaint:

Deputy Mitch Olson with the Douglas County Sheriff’s Department was dispatched to a one-vehicle crash on Highway 13 in the town of Cloverland on Dec. 2. He found a black SUV in the ditch and a lone male walking toward him.

The man, identified as Fredrick, said the airbag went off and hit him in the face. He was bleeding from two cuts on his face. When asked if he’d been drinking, Fredrick said he had about 12 beers that night, the last about an hour prior to the incident.

A preliminary breath test showed he had an alcohol concentration of 0.178, more than twice the legal limit. Fredrick has four prior drunk driving convictions on his driving record, the last from 2009.

Fredrick’s next court appearance is slated for Wednesday.
