Superior man gets 25 years for sex assault

A Superior man convicted of child sex assault six years ago was sentenced to 25 years in prison after probation was twice revoked.

Nathan Robert Adolphson, 25, received the sentence this week in Douglas County Circuit Court.

Adolphson pleaded guilty in 2006 to felony second-degree sexual assault of a child and misdemeanor fourth-degree sexual assault in connection with a sexual assault of a 13-year-old at a Summit residence in 2005, according to the criminal complaint. At the time, Adolphson was 19.

Following his guilty plea, judgment was deferred by agreement on the felony, and he was placed on two years of probation for the misdemeanor, according to online court records. The agreement and probation were revoked in 2009, at which time he was placed on 10 years of probation for the felony and sentenced to 21 months in jail.

That probation was revoked in April, a month after new felony charges were filed for an alleged sex registry violation and using a computer network without the owner’s permission. That case remains open.

At Monday’s sentencing hearing for the 2006 plea, District Attorney Dan Blank argued for a 20-year sentence. Public Defender J. Patrick O’Neill, who represented Adolphson, argued for a 12-year sentence.

Judge Kelly Thimm, however, told the court he believed both recommendations were too low based on the seriousness of the offense and the need to protect the public and Adolphson’s performance on the deferred agreement and probation.

The judge sentenced Adolphson to 10 years initial confinement and 15 years extended supervision. Conditions of Adolphson’s extended supervision include no contact with minors, completion of sex offender treatment and continue sex offender registration.
