Wisconsin DNR blames bluff collapse on no pond liner

State regulators investigating a bluff collapse at a Milwaukee-area power plant last Halloween say a "significant factor" may have been the lack of a liner in a storm-water pond.

OAK CREEK, Wis. (AP) — State regulators investigating a bluff collapse at a Milwaukee-area power plant last Halloween say a "significant factor" may have been the lack of a liner in a storm-water pond.

The state Department of Natural Resources says We Energies may have violated regulations when it built a pond in and above a coal-ash landfill on its Oak Creek site.

A Milwaukee Journal Sentinel report says the DNR issued a notice of violation to the utility on Thursday. The notice says the utility could face fines of up to $5,000 per day.

Utility spokesman Barry McNulty says the utility is disputing the finding about the liner. He says it didn't think a liner was necessary in this case.

The collapse swept mud and ash into Lake Michigan. No one was hurt.
