MADISON — So, let's say a state trooper happens to find one of the missing Democrats. Can that Democrat be arrested?
According to the state Constitution, no, said Mike Borger, an assistant to the Senate clerk, who has been assigned to research the subject.
A member of the Legislature can only be arrested for a felony, treason or for breaching the peace, said Andrew Welhouse, a spokesman for Senate Majority Leader Scott Fitzgerald.
Fitzgerald sent two state troopers to the home of Senate Minority Leader Mark Miller. But he told the News Tribune it wasn't his intention to have Miller arrested.
"We want them to understand the seriousness of this," he said.
